The information provided to you by the Association of Chiropractic Colleges, Incorporated (ACC) on its website https://chirocolleges.org/ and any other affiliated websites (known hereinafter as “Website”) are subject to the following terms of use (known hereinafter as “TOU”). Your use of the Website affirms your acceptance of the TOU and all stated rules and policies. ACC reserves the right in its discretion to update the TOU at any time without notice to you. If you do not agree to these TOU you must immediately terminate your use of the ACC website.

Lawful Use

The Website and information provided may be used for lawful purposes only. As one of the conditions of your use of the Website, you represent, warrant, and agree you will not use (or assist others to use) the Website for any purpose or in any manner that is prohibited by the TOU or by applicable law (including but not limited to any applicable export controls). Altering the Website or its information is forbidden without written permission and approval from ACC. You may not use the Website in any manner that could damage, disable, overburden, or impair or interfere with any other party’s use and enjoyment of the Website. You may not attempt to gain unauthorized access to any accounts, computer systems or networks connected to any ACC server through hacking, password mining or any other means. You may not obtain or attempt to obtain materials or information not intentionally made available through the Services.

The ACC website is provided for informational purposes only and is not intended as chiropractic or medical advice or as a substitute for the advice, diagnosis, or treatment provided by a qualified doctor of chiropractic or other health care professional.

License

You are granted a personal, revocable, limited, non-exclusive, nontransferable license to access and use the ACC website conditioned on your continued acceptance of, and compliance with, these TOU. You may use the ACC website and the ACC Content for your noncommercial personal use and for no other purpose. The ACC reserves the right to bar, restrict or suspend any user’s access to the ACC website, and/or to terminate this license at any time for any reason. The ACC reserves any rights not explicitly granted in these TOU.

Use Content Guidelines

If you use, or post User Content on, a Public Area, such as message boards, blogs, email, chat areas, news groups, forums, communities, calendars, folders and/or other message or communication options designed to enable you to communicate with others (hereinafter known as “Communications”) you agree you will be entirely responsible for all content that you upload, post, email or otherwise transmit through the Website, and understand that any online communications may not be confidential. ACC is not responsible for any information posted by a third party. You agree you will comply with all laws related to copyright and intellectual property, and will not post any materials that violate any laws, advocate illegal activity, infringe upon a third-party copyright, or invade the privacy or publicity rights of others. You also agree not to post, publish, upload, distribute or disseminate anything that is inappropriate, profane, knowingly false, defamatory, vulgar, obscene, threatening, abusive, hateful, pornographic, embarrassing or has potential to cause harm or damage to anyone.

Any message posted are the express view of the poster and does not reflect the views of ACC. ACC has no obligation to, and does not in its normal course, pre-screen, monitor or review the materials posted online. ACC is not responsible for and does not exert editorial control over any materials posted online, however, ACC reserves the right to pre-screen, monitor and/or review all materials posted, or to refuse to post or remove a post.

Personal Login Information

Certain features and areas of the ACC websites may be available only with registration, login and/or a paid subscription. If you are required to register and select a unique login and password (“Personal Login Information”), you must keep your Personal Login Information confidential. Your Personal Login Information is personal to you and you may not allow any third party to use it under any circumstances. The ACC is not liable for any harm caused by or related to the theft, misappropriation, disclosure, or unauthorized use of your Personal Login Information. You must contact ACC immediately if you become aware of or believe there is or may have been any unauthorized use of your Personal Login Information, or otherwise wish to deactivate your Personal Login Information due to security concerns.

Use Limitations

Unless otherwise specified, the Website information is for your personal and non-commercial use. For purposes of these TOU, non-commercial use does not include a chiropractic practice. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Website.

ACC makes every effort to present accurate information but does guarantee accuracy, completeness, efficacy, nor does it represent, warrant, endorse, approve, or certify any information displayed, uploaded, downloaded, or distributed.

No Endorsement

The appearance of advertisements or vendor information on the Website does not imply approval, endorsement, certification, warranty, or representation. Doctors should consult their respective state licensing boards for practice-related issues in their state.

ACC Online Communities

Regarding the online communities, you agree to the following:

  • You will not use communities for any illegal purpose or for any purpose that could expose ACC to liability for any matter, including, but not limited to, antitrust violations defamation, negligence, and violation of contract.
  • You will indemnify, save, defend and hold ACC harmless from any and all liabilities, action, demands and damages, of any nature including, but not limited to, reasonable attorneys’ fees, arising out of or related to your use of this discussion board.
  • You will refrain from using any offensive, derogatory or inflammatory comments. ACC does not endorse, approve or sanction any comment, statement or claim that you may make or is made by any person and/or entity.
  • ACC reserves the right to, at any time and for any reason determined in its sole discretion, restrict and/or eliminate your use of this discussion board. There is no right of privacy attaching to your discussion in a community, or to that of any other person and/or entity, and ACC may, but shall not be obligated to, monitor your discussions and those of other persons and/or entities for purposes of determining compliance with these policies. ACC also reserves the right to amend or modify these rules, at any time and for any reason as determined by ACC in its sole discretion.

Jurisdiction

The provisions of this TOU are subject to the laws of the Commonwealth of Virginia.

Severability

If any provision of this TOU shall be unlawful, void or unenforceable for any reason, the other provisions shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent.

Trademarks

The trademarks, logos, service marks, text and content displayed on the Website are the property of ACC or other third parties.
